TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of fettcher.com and the pickup and purchasing services provided by Fettcher LLC ("Fettcher," "we," "us," or "our").
By scheduling or confirming a pickup through Fettcher, you agree to these Terms.
ABOUT FETTCHER
Fettcher provides a local pickup service through which customers may offer eligible used goods for purchase.
We may provide a preliminary estimate based on the information you submit, arrange a pickup, inspect the items presented, and provide a final offer for the items we are willing to purchase.
PRELIMINARY ESTIMATES
Any estimate displayed before inspection is preliminary only. It is not a guaranteed purchase price and is not a binding offer to purchase your items.
Estimates may be based on the categories, quantities, estimated weights, condition information, photographs, and other information you provide.
Actual quantity, weight, condition, eligibility, and other characteristics may differ when the items are inspected. As a result, the final offer may be higher or lower than the preliminary estimate.
ITEM OWNERSHIP AND AUTHORITY
By submitting items through Fettcher, you represent that you own the items or otherwise have lawful authority to sell or transfer them.
You may not submit stolen property, property subject to another person's ownership claim, counterfeit goods, illegal goods, hazardous materials, or other property that cannot lawfully be sold or transferred.
You are responsible for providing accurate information about the items you submit.
ITEM ELIGIBILITY AND CONDITION
Items must meet Fettcher's current eligibility and condition requirements.
Fettcher may refuse any item for lawful reasons, including condition, damage, contamination, odor, moisture, infestation, safety concerns, inaccurate descriptions, insufficient resale or reuse value, prohibited-item status, or failure to meet our current purchasing criteria.
Scheduling a pickup does not require Fettcher LLC to purchase every item presented.
INSPECTION AND FINAL OFFER
Items may be inspected before a final purchase decision is made.
After inspection, Fettcher may identify which items we are willing to purchase and provide a final offer.
You are not required to accept the final offer.
Items that are not included in an accepted final offer remain your property unless you separately agree otherwise.
If Fettcher already has possession of items that are not purchased, you and Fettcher will arrange the appropriate return, pickup, donation, disposal, or other handling of those items as mutually agreed.
ACCEPTANCE AND TRANSFER OF OWNERSHIP
A purchase occurs only when you accept Fettcher's final offer.
Ownership of items included in an accepted final offer transfers to Fettcher LLC upon your acceptance of the final offer and completion or issuance of the applicable payment, unless you and Fettcher agree otherwise in writing.
After ownership transfers, Fettcher LLC may resell, donate, recycle, repair, dispose of, bundle, or otherwise use or transfer the purchased items at its discretion.
PAYMENT
Payment will be made using a payout method offered for the transaction.
Payment timing may depend on completion of inspection, acceptance of the final offer, verification of transaction information, the selected payout method, and processing by third-party financial institutions or payment providers.
You are responsible for providing accurate information necessary to complete your payment.
PICKUP SCHEDULING
Pickup dates and time windows are estimates.
Pickup timing may be affected by traffic, weather, routing, vehicle availability, staffing, capacity, previous pickups, or other circumstances.
Fettcher may contact you if a scheduled pickup needs to be delayed, changed, or cancelled.
Where the Service allows you to reschedule or cancel a pickup, changes may be subject to the cutoff time displayed through Fettcher.
You are responsible for providing safe and reasonable access to the items at the scheduled pickup location.
SERVICE AREA AND AVAILABILITY
Fettcher operates only in areas that we currently support.
Availability may be limited based on ZIP code, pickup capacity, pickup dates, item categories, item quantities, operating conditions, or other business requirements.
Fettcher LLC may expand, reduce, temporarily suspend, or discontinue service in any location.
PROHIBITED OR UNSAFE ITEMS
Do not offer items that are unlawful to possess, sell, or transfer or that create an unreasonable health or safety risk.
Fettcher may refuse hazardous, contaminated, infested, recalled, counterfeit, stolen, illegal, or otherwise unsuitable property.
If we reasonably believe an item may be unlawful or unsafe, we may refuse the item and take any action required by applicable law.
COMMUNICATIONS
Fettcher may send transactional emails concerning your pickup or transaction, including booking confirmations, scheduling information, rescheduling notices, pickup updates, final offers, seller decisions, cancellations, payment information, and customer-service communications.
If you separately consent to transactional text messages, Fettcher may also send pickup-related SMS messages.
Consent to SMS messages is not required to use Fettcher.
You are responsible for providing accurate contact information.
WEBSITE AND SERVICE USE
You may not:
Submit intentionally false or fraudulent information.
Offer property you do not own or otherwise have authority to sell.
Attempt unauthorized access to Fettcher systems or accounts.
Interfere with the operation or security of the Service.
Abuse promotional programs, discounts, or offers.
Use automated systems in a manner that disrupts or burdens the Service.
Use Fettcher for illegal or fraudulent purposes.
Fettcher LLC may restrict or refuse service where reasonably necessary to protect customers, employees, contractors, property, systems, or the business.
CANCELLATIONS AND RESCHEDULING
Customers may be able to cancel or reschedule eligible pickups through Fettcher's customer-management features.
Changes may be restricted after the cutoff time associated with the scheduled pickup.
Fettcher LLC may also cancel or reschedule a pickup because of capacity, staffing, weather, safety concerns, service-area changes, vehicle issues, or other operational circumstances.
PROMOTIONS AND BONUSES
Fettcher may offer promotions, pickup-window bonuses, or other incentives from time to time.
Promotions may have eligibility requirements, limits, expiration dates, service-area restrictions, or other conditions.
Unless otherwise stated, promotions have no cash value apart from an eligible Fettcher transaction and may not be transferred.
Fettcher LLC may refuse or reverse promotional benefits obtained through fraud, duplicate claims, manipulation, or misuse.
DISCLAIMER
Fettcher is provided on an "as available" basis.
We do not guarantee that every submitted item will qualify, every preliminary estimate will result in a purchase, every item will be accepted after inspection, every requested pickup time will remain available, or the Service will always operate without interruption.
Nothing in these Terms limits any rights or remedies that cannot lawfully be limited or waived.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Fettcher LLC and Fettcher will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Service.
This limitation does not apply where liability cannot lawfully be excluded or limited.
CHANGES TO THESE TERMS
Fettcher LLC may update these Terms as the Service, business practices, or legal requirements change.
The version and effective date displayed at the top identify the Terms currently in effect.
When required through our booking process, customers are asked to acknowledge the version of these Terms presented when they confirm a pickup.
GOVERNING LAW
These Terms are governed by the laws of the State of Texas, except where applicable law requires otherwise.

ABOUT FETTCHER
Fettcher provides a local pickup service through which customers may offer eligible used goods for purchase.

Scheduling a pickup does not require Fettcher LLC to purchase every item presented.
INSPECTION AND FINAL OFFER
Items may be inspected before a final purchase decision is made.
After inspection, Fettcher may identify which items we are willing to purchase and provide a final offer.
You are not required to accept the final offer.
Items that are not included in an accepted final offer remain your property unless you separately agree otherwise.
If Fettcher already has possession of items that are not purchased, you and Fettcher will arrange the appropriate return, pickup, donation, disposal, or other handling of those items as mutually agreed.
